Terms of Service

These are the terms for using StreamDay, a service operated by Virtue Apps (a sole proprietorship registered in Ontario, Canada).

By using StreamDay, you agree to these terms. If you do not agree, do not use the service.

What StreamDay is

StreamDay is a scheduling tool for streamers and streaming events. You create events, list participating streamers and their schedules, and share a public link to the event page. That is it.

StreamDay is a tool, not an event organiser. We do not host streams. We do not guarantee that any streamer will actually appear at the time listed. We do not verify the identity of streamers listed in events.

Who can use it

To use StreamDay you need:

  • A Discord account in good standing
  • To meet Discord's minimum age requirement in your country (13 in most places, 16 in some EU countries)
  • The legal capacity to enter into these terms

Because Discord is the only sign-in method we offer, and Discord enforces its own age and account requirements, you must comply with Discord's terms in order to use ours.

Your account

  • You are responsible for keeping your Discord account secure. If someone gets into your Discord, they can get into your StreamDay.
  • You are responsible for everything that happens under your account.
  • One person or organisation may run multiple accounts. Each account requires its own subscription to publish if you use the paid annual plan.
  • You can delete your account at any time from your settings. Deletion is immediate and permanent.

Acceptable use

Do not:

  • Post illegal content of any kind
  • Impersonate other streamers, brands, or people
  • Use the service to harass, abuse, or threaten anyone
  • Scrape the service or use bots, scripts, or automated tools to access it (except where explicitly permitted by us in writing)
  • Try to break, overload, or exploit the service or its infrastructure
  • Reverse engineer or copy the service to build a competing product
  • Use the service to distribute malware, phishing pages, or scams

We may suspend or terminate any account that violates these rules, without notice and without refund.

Your content

When you create events, upload avatars, or enter streamer information, that content remains yours. You give us a limited licence to host, store, display, and distribute that content as needed to run the service, including showing it on public event pages and sharing it through public links you generate.

You are responsible for:

  • Having the rights to anything you upload or post
  • Having permission to list other streamers and their channels in your events
  • The accuracy of event information

We may remove content that violates these terms or that we receive a valid legal notice about.

Public event pages

When you publish an event, the event page becomes accessible to anyone with the share link. Treat anything you publish as public information. Do not put private data into event titles, descriptions, or anywhere else that gets published.

Payments and subscriptions

StreamDay offers two paid options:

  • Per event: $9.99 USD, one time, to publish a single event.
  • Annual subscription: $19.99 USD per year, per account, for unlimited event publishing on that account, subject to fair use (see below).

You can register for the service and explore the offering for free without paying, but publishing events requires a paid option.

If you run multiple StreamDay accounts, each account needs its own subscription if you want unlimited publishing on it.

Fair use on the annual plan

The annual unlimited plan is intended for normal use by a single streamer or organisation. We may flag accounts that:

  • Publish an unusually large number of events relative to actual streaming activity
  • Use automated tools or scripts to mass-create or mass-publish events
  • Resell or redistribute the publishing capability to third parties
  • Otherwise use the plan in a way that imposes outsized cost or load on our infrastructure

If we believe your use is unfair, we may impose reasonable numeric limits, suspend the account, or require an upgrade to a higher tier if we introduce one. We do not collect your personal contact information for privacy reasons, so we do not have a way of contacting you directly.

Payments are handled by Paddle

Paddle is our Merchant of Record. This means Paddle, not us, sells the subscription or per-event purchase to you. Paddle is responsible for collecting payment, applying applicable taxes (including VAT, GST, HST, and sales taxes), and complying with payment regulations in your country.

Refunds

We do not offer refunds, except where required by law in your country. If you are entitled to a refund under consumer protection law in your jurisdiction, contact us and we will handle it through Paddle.

This means:

  • No refunds for partially used subscription periods
  • No refunds for events you chose not to publish after paying per event
  • No money-back guarantee period

Failed payments and cancellation

If a subscription payment fails, we will attempt to retry. If payment continues to fail, your subscription will lapse and you will lose access to publishing on that account. Your account data and unpublished events will remain unless you delete the account.

You can cancel a subscription at any time from your account settings or through Paddle. Cancellation stops future renewals. You keep access until the end of the period you have paid for.

Price changes

We may change pricing. Existing subscriptions continue at the price you signed up at until the next renewal. We will notify you by email at least 30 days before a renewal at a new price.

Intellectual property

StreamDay, the StreamDay name, logo, and all related branding belong to Virtue Apps. The code, design, and infrastructure of the service belong to Virtue Apps.

You do not get any rights to our brand or our code by using the service. You can refer to StreamDay by name to describe that you use it.

You retain ownership of your content. We only get the licence described in the "Your content" section above, and only for as long as needed to run the service or as you have made your content public.

Service availability

The service is provided "as is" and "as available." We do not guarantee:

  • That the service will be available at any particular time
  • That the service will be free of bugs or errors
  • That data will not be lost due to technical issues, our or our providers' fault, or events outside our control
  • That share links or features will continue to work indefinitely

We try our best, but we are a small operation. Do not rely on StreamDay as the only record of your event information. Keep your own copies of anything important.

Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
  • We are not liable for lost profits, lost data, lost goodwill, or business interruption.
  • Our total liability to you for any claim related to the service is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $100.

This limit applies regardless of the legal theory of the claim (contract, tort, statute, or otherwise).

Some jurisdictions do not allow certain limitations on liability. If you live in one, the limitations above apply to the maximum extent the law allows, and may not apply to you in full.

Indemnification

You agree to indemnify and hold harmless Virtue Apps and its operator(s) from any claims, damages, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the service
  • Your content
  • Your violation of these terms
  • Your violation of someone else's rights, including intellectual property and privacy rights

Suspension and termination

We may suspend or terminate your account if:

  • You violate these terms
  • You use the service in a way that creates legal risk for us
  • You fail to pay for a paid subscription
  • We are required to by law

You may delete your account at any time. Deletion is immediate and permanent.

If we terminate your account for cause, you are not entitled to a refund of any prepaid amounts.

Changes to these terms

We may update these terms. When we do, we will update the "Last updated" date at the top.

For minor changes (typos, clarifications), the updated terms take effect when posted. For material changes (those that meaningfully affect your rights or obligations), we will notify you within the app the next time you visit. If you do not agree with the change, you can delete your account at that time.

If you keep using the service after changes take effect, you accept the updated terms. If you do not agree with the changes, stop using the service and delete your account before they take effect.

Governing law and disputes

These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada that apply there. Any dispute arising out of these terms or your use of the service must be brought in the courts of Ontario, and you agree to the exclusive jurisdiction of those courts.

If you live somewhere with mandatory consumer protection law, nothing in these terms removes rights you have under that law.

Other things

  • Severability: if any part of these terms is found unenforceable, the rest still applies.
  • No waiver: if we do not enforce a part of these terms once, that does not mean we have given up the right to enforce it later.
  • Assignment: you cannot transfer your rights under these terms. We can transfer ours, for example if the business is sold.
  • Entire agreement: these terms, together with the Privacy Policy, are the full agreement between you and us about the service.
